I have been summoned as a suspect. What should I do?
First of all, do not make any statement without a lawyer. Being summoned as a suspect (investigado, formerly 'imputado') means you are attributed possible involvement in an act, but it is not a conviction. You have the right to remain silent, not to incriminate yourself and to appoint a lawyer of your choosing. Speak with a criminal lawyer before your statement so you can prepare your defence and review the case file.
What is assistance for detainees and when does the lawyer step in?
Anyone who is detained has the right to a lawyer from the very first moment. The lawyer meets privately with the detainee before any statement, safeguards their rights during it and requests whatever procedural steps are needed. You may appoint a lawyer you trust; if you do not, a duty solicitor is assigned to you.
Can I appear as a private prosecutor if I am the victim of a crime?
Yes. The victim can act as a private prosecutor and take part in the proceedings with their own lawyer, seeking a conviction of the person responsible and compensation for the harm suffered, rather than leaving the prosecution solely in the hands of the Public Prosecutor.
When can my criminal record be cleared?
A criminal record is cleared once the sentence has been served and the time limits under article 136 of the Criminal Code have passed. These vary with the severity of the penalty, from 6 months for minor penalties up to 5 years or more for serious ones, provided there is no reoffending. We handle the removal for you before the Central Criminal Records Registry.
I have received a court summons. Am I required to attend?
A court summons must be answered, but go with proper advice: before making any statement it is worth knowing in what capacity you are being called and what the case involves. Failing to appear can have consequences, and so can making a statement without preparation.
Can I withdraw a complaint I have already filed?
For public offences, which are the majority, the proceedings continue of their own accord even if you wish to withdraw the complaint, because prosecution does not depend on the victim alone. With some semi-public or private offences there is more leeway. We will explain what happens in your particular case.
